Terms of Use

1. Who we are

kasvulava is run by RSM Investments OÜ (registry code 16127607), Aia tn 9/2, 80014 Pärnu, Estonia, privacy@kasvulava.eu ("we", "us").

2. The service

kasvulava is a marketplace for jobs, company information and networking events at startups, scaleups and SMEs in Estonia. Candidates can build a profile, save and apply for jobs and register for events. Companies and event organisers can publish job posts, company profiles and events and handle applications.

kasvulava is free for candidates.

We may change, add or remove features. We'll give reasonable notice of changes that significantly affect you.

3. Accounts

• You must be at least 16 years old to create an account.
• Give accurate information and keep it up to date. Company and organiser accounts must be created by people authorised to act for that organisation.
• You sign in with one-time links sent to your email. Keep access to your email secure; you're responsible for activity in your account.
• Each account has one type (candidate, company or event organiser), chosen at sign-up.

4. Rules for candidates

Your profile and applications must be truthful and must be your own. When you apply, you agree that the company sees the information listed in our Privacy Policy. kasvulava isn't a party to any job offer or employment contract between you and a company.

5. Rules for companies and event organisers

• Job posts must describe real, open positions with your organisation, and include accurate information about the role, location and pay where shown.
• Job posts must comply with Estonian law, including the Employment Contracts Act and the Equal Treatment and Gender Equality Acts. Don't discriminate based on gender, age, ethnic origin, religion, disability, sexual orientation or other protected grounds.
• Use candidates' data only to assess their application for the role they applied to, keep it confidential and delete it when you no longer need it. For that data you are a controller in your own right and responsible under the GDPR.
• Events must be real and accurately described. Imported event details must be yours to share.
• Only verified facts set by kasvulava are shown as verified. Don't present your own claims as verified.

6. Content you publish

You keep the rights to content you publish (such as your profile, job posts, company profiles and events). You give us a non-exclusive, free licence to host, show and share it within kasvulava and to promote the service, for as long as it is on kasvulava.

You must not publish content that:

• is illegal, misleading, fraudulent or infringes others' rights (such as copyright, trade marks or privacy);
• is discriminatory, hateful, harassing or threatening;
• is spam, a pyramid scheme, an unpaid "trial work" scheme or a job that doesn't exist;
• contains malware or tries to break or overload the service, or scrapes it in bulk without our permission.

7. Review and moderation

Job posts and company events are reviewed by kasvulava before they go live, unless the organiser is a trusted organiser. We may refuse, edit for formatting, hide or remove content, and suspend or close accounts that break these terms or the law. Decisions are made by people, not by automated systems.

When we restrict your content or account, we tell you which content is affected, why (the law or the rule in these terms), and how you can contest the decision. You can ask us to review any such decision by replying to privacy@kasvulava.eu within six months; we'll handle it promptly and without automated means. You may also use any out-of-court dispute settlement body or court.

8. Reporting illegal content

Anyone can report content they believe is illegal or breaks these terms by writing to privacy@kasvulava.eu. To help us act quickly, include:

• why you believe the content is illegal or breaks the rules;
• the exact link (URL) to the content;
• your name and email address (unless the report concerns child sexual abuse material);
• a statement that you believe in good faith that the report is accurate and complete.

We confirm receipt, review reports diligently and objectively, and tell you what we decided. We act quickly on obvious illegal content.

9. Availability

We work to keep kasvulava available and secure but can't guarantee it will always be uninterrupted or error-free. We may take it offline for maintenance.

10. Liability

Information on kasvulava, including job posts, salaries and company facts, comes partly from companies and other users. We review it with care but can't guarantee it is complete or correct. We aren't responsible for the hiring decisions of companies or the conduct of users.

We're liable for damage we cause intentionally or through gross negligence, and as mandatory law requires. Otherwise, to the extent the law allows, we aren't liable for indirect damage or lost profits. Nothing in these terms limits your rights as a consumer under mandatory law.

11. Ending your use

You can stop using kasvulava and delete your account at any time in your profile settings. If you're the only member of a company account, contact us to close the company profile. We may close accounts that seriously or repeatedly break these terms, after a warning where reasonable.

12. Changes to these terms

We may update these terms. We'll tell account holders about significant changes by email or on the site at least 15 days before they take effect. If you don't agree, you can delete your account before then.

13. Governing law and disputes

Estonian law applies to these terms. Disputes are resolved in Estonian courts (Pärnu County Court as the court of first instance), but if you're a consumer you can also go to the courts where you live and keep the protection of the mandatory laws of your country of residence. Consumers can also turn to the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority (TTJA).
